Terms Of Service
Please read the following very carefully. Use of any TheGraphicsLady.com websites constitute your agreement to the Terms Of Service as written below.
If you do not agree with any of these terms you can leave this site now and do not participate or make use of any of our other sites.
For your convenience we've categorized the different licenses of use and common terms that may be found throughout our network of sites. We hope this makes for an easier read and understanding of what exactly everything means and what you are allowed to do in each case:
Linkware Graphics and Website Templates
Linkware Graphics and/or Website Templates refer to any custom graphic designs or website templates that are FREE for you to use in exchange for a CLICKABLE LINK back to us.
All Linkware Graphics and Website Templates will be clearly labelled as such so there will be no confusion as to how you may use them.
You may use the specified Linkware Graphics and Website Templates on your personal as well as your commercial websites.
There is no extra licence fee for commercial websites.
Please note that a CLICKABLE link back to us crediting our work must be displayed on EVERY page where our Linkware graphics and Website Templates are used.
Linking to us on a back page, a "links page" or a "credit page" is not acceptable and considered a violation of these terms.
Any graphics or website templates in this category fall under the "what you see is what you get" rule. They may not be altered or changed in any way and can only be used "as is". You may not resize, recolour, crop, duplicate, mix or change the appearance in any way.
There is only 1 exception to this rule: That is where we have provided blank buttons, banners or headers for you to add your own text to. You may not alter the graphic but you may add your own text to create your own personalized graphic.
Whenever our link is designed into the actual graphic, you may not remove it. All graphics and website templates in the LINKWARE section are always free for you to use. A CLICKABLE link back to us is a small price to pay for their use. Please respect this.
Purchaseware Graphics and Website Templates
Purchaseware Graphics and Website Templates are ready to go custom graphic designs or complete graphic websets (this includes full mini-site layouts) that we have already created and have displayed as "available for purchase".
There are 2 possible options:
1. You may purchase the graphics/set as a public "template". This is the cheaper option but does not give you exclusive use of anything. The graphics and/or website templates are resold multiple times and others may also be using them.
2. Sometimes we will specify that you can purchase the graphics/set as an "upgraded template".
This means that once payment is made we will remove the graphics or graphic sets from our site and you will be the new owner.
Please remember: For Purchaseware Graphics and Website Templates - option #2, they have previously been available to purchase as " public templates" so there may be others using the exact same design. Those people have the right to continue to use their graphics or website template. However, once you have purchased the set as an "upgraded template", it will no longer be available to anyone else after that point.
Both options are cheaper than having a 100% custom graphic design set done for you by a designer. This is becasue Purchaseware Graphics and Website Templates are aleady designed. You just need to choose the one you like and make payment.
A link back to us on every page where our graphics are being used is still required with our Purchaseware Graphics.

Freeware Graphics and Free Web Page Backgrounds
Freeware Graphics and Free Web Page Backgrounds refer to any graphic designs found on any of our sites that are FREE for you to use on your personal as well as your business websites.
All available Freeware Graphics and Free Web Page Backgrounds will be clearly labelled as such so there can be no confusion as to how they may be used.
NO link back to us is required to use our Freeware Graphics, however if you choose to credit our work, we won't complain. :o}
YES! Graphics designers, you may use anything in this section to create your own designs and/or website templates for resale.
Anything in this category CAN be altered, edited, changed, cropped, chopped, diced, mutilated, mangled and otherwise reworked as you need.
NOTE!!! TheGraphicsLady.com still retains the copyright to the graphics and free web page backgrounds so you may NOT display or distribute them "as is" and say you created them yourself. You must work them into a design of your own. Your finished work can then be sold and/or distributed.
In other words: You can use the graphics and free web page backgrounds for YOUR OWN websites if you wish, but you cannot re-distribute them as is, or bundle them up and sell them, or repackage them and give them away, or add them to a graphic gallery or a web page background gallery, or put them on CD or offer them for download...or anything else that constitutes you 'giving or selling them to someone else' or falsely displaying them as your own work. None of that is allowed! But you can slice and dice and colour and alter them as needed to create something NEW.
The NEW IMAGE(s) and/or website templates that you create are yours to do what you want with.
Downloading Our Graphics and Web Page Backgrounds
YOU MAY NEVER DIRECTLY LINK TO OUR GRAPHICS. You MUST download any of the graphics and web page backgrounds that you wish to use onto your own hard drive and then upload them to YOUR server.
Where there are many images like in the case of a whole graphic design set or website template, we may provide a zipped file of all the images and graphics needed. You will still need to download the zip file, save it to your computer, unzip it and then upload everything to your server.
From time to time we will change the path to our graphics and you'll have broken images if you use direct linking tactics!
Please note that this is called bandwidth stealing and it costs us money. It is also illegal and immoral. So just DON'T DO IT!
To help prevent direct linking to our graphics, the right click function has been disabled on many of our graphics pages.
Password Protected Galleries
Some of our downloadable graphics/content is inside different password protected areas. Some free and some for a fee. In either case, you may NOT share your login details with anyone.
From time to time we will change the username and password to enter password protected areas. New login info will be sent via e-mail. In order to receive the new password you must remain on our membership list or you will not have continued access to the password protected areas once the password has been changed.
Content Approved Rating
Our graphics/content are NOT allowed on any web site that is not fit for a general audience or family website. This includes but is NOT limited to web sites which contain adult material, nudity, warez, or website and web pages that promote hate, racism, pornography, anything illegal, or any other "questionable" related material.
We have the sole discretion to decide what web sites may use our graphics/content. If we feel your web site is not suitable, we will ask that you discontinue the use of our graphics/content. You agree that if this should happen, you will comply and promptly discontinue any use of our material.
Copyright Information - PLEASE READ!!
All graphics/content displayed on any pages within our sites, regardless of their category (Linkware, Freeware, Purchaseware, Resale, etc.) remain copyright to TheGraphicsLady.com. They are NOT public domain nor are they royalty free.
Whether you purchase them or not, whether you link back or not, we retain ALL coyrights to our graphics and content.
What does this mean:
This means you may NEVER claim copyright yourself.
You may NEVER claim ownership of the material.
You may NEVER say you created or designed them yourself.
You may NOT sell, give away or distribute or include our graphics and content material to any collections, memberships, or download sites, etc. under any circumstances.
You are granted a SINGLE users license only. Do not repackage them, do not add them to any galleries or auction sites such as Ebay, download sites or membership sites, do not include them as a bonus, do not put them on a CD or offer them for download...or anything else that constitutes you 'giving them or selling them to someone else' or falsely displaying them as your own work.
Violations Of These Terms
If you find someone violating these conditions and not using our graphics/content as outlined in these terms please e-mail us and let us know.
If YOU are found violating these terms, you must IMMEDIATELY discontiue the use of our work.
We work many hours designing these graphics and creating content for you to use. All we ask is that you abide by our terms. If you can't, then don't use our graphics, our content, or our websites and go create your own. It's that easy.
Your Understanding of This Agreement
You understand and agree to ALL of the terms written above.
You understand and agree that we reserve the right to refuse the use of our graphics/content and/or may discontinue our services, if at any time we feel you are abusing or misusing our web site graphics/content or have violated our terms in ANY way. If this should happen, you agree that you will discontinue the use of our material immediately.
If you are unsure about any part(s) of this agreement or if what you want to do is acceptable under these terms just e-mail and ask. Never assume.
